1. Introduction and Service Provider

These Terms of Service ("Terms") govern your access to and use of the TailorForCV service (the "Service"), operated at tailorforcv.com and tailor4cv.com (collectively, the "Website").

2. Acceptance of Terms

By accessing, browsing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Service.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into a binding contract
• You are not prohibited from using the Service under applicable laws
• All information you provide is accurate, current, and complete

4. Description of Service

TailorForCV is an AI-powered platform that provides the following services:

• CV Analysis: Upload your CV (resume) and a job description to receive a detailed match score, identify missing keywords, and discover experience gaps
• CV Tailoring: Generate tailored versions of your CV optimized for specific job applications
• Master Profile Management: Create and maintain a comprehensive professional profile including skills, experience, education, and projects
• Job Application Tracking: Organize and track your job applications with status updates and notes

The Service uses artificial intelligence (AI) from multiple providers (Google Gemini, OpenAI, Anthropic Claude) to analyze and generate content. Results are provided for informational purposes only.

5. User Accounts

5.1 Account Creation

To access certain features, you must create an account. Account creation and authentication are managed by Clerk, a third-party service provider. You may register using:

• Email and password
• Social login providers (Google, etc.)

5.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

You must not share your account credentials or allow others to access your account. We are not liable for any loss or damage arising from unauthorized account access.

5.3 Guest Access

We may offer limited guest access to certain features without account registration. Guest analyses may be subject to additional restrictions and are not saved permanently.

6. Payment Terms and Credits

6.1 Credit System

The Service operates on a credit-based system. Credits are required to unlock detailed analysis results and generate tailored CVs.

• Initial Credits: New accounts receive 50 free credits upon registration
• Credit Usage: Each action (job analysis, CV tailoring) consumes a specified number of credits
• Credit Purchase: Additional credits can be purchased through our payment provider, Stripe

6.2 Pricing

Current pricing for credit packages is displayed on the billing page within your account dashboard. All prices are listed in the currency displayed at the time of purchase and include applicable VAT (if required).

6.3 Payment Processing

Payments are processed securely by Stripe, a third-party payment processor. We do not store your credit card information. By making a purchase, you agree to Stripe's terms and conditions.

6.4 Credit Expiration

Purchased credits may have an expiration date as specified at the time of purchase. Promotional or free credits may expire according to the terms of the promotion. We will notify you via email before your credits expire.

6.5 Refund Policy

Under EU consumer protection law, you have the right to withdraw from a purchase within 14 daysof the transaction date, provided you have not used the credits.

• Transaction ID or date
• Reason for refund request

Refunds are processed within 14 days of approval and returned via the original payment method. Credits used for AI processing (analysis, tailoring) are non-refundable as they incur immediate costs from our AI providers.

6.6 Failed or Incomplete Processing

If an AI analysis or CV tailoring fails due to a technical error on our side, the consumed credits will be automatically refunded to your account. If you believe credits were incorrectly deducted, contact support within 30 days of the incident.

7. User Content and Intellectual Property

7.1 Your Content

"User Content" includes all data, text, documents, CVs, job descriptions, and other materials you upload, submit, or store in the Service.

You retain all ownership rights to your User Content. By uploading User Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to:

• Store, process, and transmit your User Content to provide the Service
• Send your User Content to AI providers (Google Gemini, OpenAI, Anthropic Claude) for analysis and processing
• Create derivative works (tailored CVs, analysis reports) based on your User Content

This license terminates when you delete your User Content or close your account, subject to retention requirements in our Privacy Policy.

7.2 AI-Generated Content

Content generated by our AI service (analysis reports, tailored CVs, recommendations) is created specifically for you based on your User Content.You own the AI-generated content and may use, modify, and distribute it as you see fit.

However, we do not guarantee:

• Accuracy, completeness, or suitability of AI-generated content for any particular purpose
• That AI-generated content is free from errors, biases, or inaccuracies
• That use of AI-generated content will result in job interviews, offers, or employment

7.3 Our Intellectual Property

The Service, including its software, design, text, graphics, logos, and all other content (excluding User Content), is owned by us and protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or reverse-engineer any part of the Service
• Use our trademarks, logos, or branding without written permission
• Create derivative works based on the Service
• Frame or mirror any part of the Service

7.4 User Representations

You represent and warrant that:

• You own or have the necessary rights to all User Content you submit
• Your User Content does not infringe any third-party intellectual property rights
• Your User Content does not contain false, misleading, or defamatory information
• You will not upload copyrighted materials without authorization

8. Prohibited Uses

You agree not to use the Service for any unlawful purpose or in any way that could harm us, our users, or third parties. Specifically, you must not:

• Legal violations: Violate any applicable laws, regulations, or third-party rights
• Fraudulent activity: Create fake accounts, impersonate others, or engage in fraudulent activities
• Abusive content: Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Security threats: Attempt to gain unauthorized access to our systems, introduce viruses, malware, or conduct security attacks
• Automated abuse: Use bots, scrapers, or automated tools to access the Service without permission
• AI exploitation: Attempt to extract, reverse-engineer, or misuse our AI prompts and systems (jailbreaking)
• Reselling: Resell, redistribute, or commercially exploit the Service without authorization
• System interference: Interfere with or disrupt the Service or servers/networks connected to the Service
• Data harvesting: Collect user information without consent or for unauthorized purposes

Violation of these prohibitions may result in immediate account suspension or termination, with or without notice.

9. AI Service Disclaimers

9.1 Nature of AI Services

Our Service uses artificial intelligence to analyze CVs and generate content. AI technology is inherently probabilistic and may:

• Produce inaccurate, incomplete, or misleading results
• Exhibit biases present in training data
• Misinterpret context or nuances in your CV or job descriptions
• Generate grammatically incorrect or awkward phrasing
• Fail to capture your unique qualifications or experience

9.2 No Guarantees

We explicitly disclaim any guarantees or warranties that:

• Use of the Service will result in job interviews, offers, or employment
• AI-generated match scores accurately reflect your suitability for a position
• Tailored CVs will be preferred by hiring managers or applicant tracking systems (ATS)
• AI analysis is complete, accurate, or suitable for your specific situation
• The Service will be uninterrupted, error-free, or always available

9.3 User Responsibility

You are solely responsible for reviewing, verifying, and editing all AI-generated content before use.You should:

• Carefully review all tailored CVs for accuracy and appropriateness
• Verify that AI-generated content reflects your actual experience and skills
• Ensure no false or misleading information is included
• Use your professional judgment when applying AI recommendations

The Service is a tool to assist you—it does not replace your own review and judgment.

10. Service Availability and Modifications

We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to:

• Scheduled maintenance or updates
• Technical issues or server outages
• Third-party service provider failures (AI providers, hosting, payment processing)
• Force majeure events beyond our control

We reserve the right to:

• Modify, suspend, or discontinue any feature of the Service at any time
• Change pricing and credit costs with 30 days' notice
• Impose usage limits or restrictions as necessary

Material changes affecting core functionality will be communicated via email at least 30 days in advance.

11. Limitation of Liability

To the maximum extent permitted by Polish and EU law:

11.1 Indirect Damages

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Lost profits, revenue, or business opportunities
• Loss of job opportunities or employment
• Damage to professional reputation
• Loss of data or content
• Cost of substitute services

11.2 Liability Cap

Our total aggregate liability for any claims arising from your use of the Service shall not exceed the greater of:

• The total amount you paid to us in the 12 months preceding the claim, or
• 100 PLN (one hundred Polish złoty)

11.3 Exceptions

Nothing in these Terms shall exclude or limit liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded under Polish or EU law

11.4 Consumer Rights

If you are a consumer under EU law, you have statutory rights that cannot be excluded. Nothing in these Terms affects those rights.

12. Indemnification

You agree to indemnify, defend, and hold harmless Operational Excellence With Dmytro Krasnoshlyk and its officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your User Content or use of AI-generated content
• Your violation of any third-party rights
• Your misuse of the Service

13. Account Termination

13.1 Termination by You

You may close your account at any time through your account settings or by contacting us at[email protected].

Upon account closure:

• Unused credits will be forfeited (no refund)
• Your data will be deleted according to our Privacy Policy retention schedule
• You will lose access to all stored CVs, analyses, and generated content

13.2 Termination by Us

We may suspend or terminate your account immediately, with or without notice, if:

• You violate these Terms or our Privacy Policy
• You engage in fraudulent, abusive, or illegal activities
• Your account remains inactive for 3 months after credit expiration (with 30 days' advance notice)
• We are required to do so by law or legal process
• We discontinue the Service (with 60 days' notice)

In case of termination for cause, no refunds will be provided.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Wrocław, Poland.

If you are a consumer resident in the EU, you also have the right to bring proceedings in the courts of your country of residence.

15. Dispute Resolution for Consumers

15.1 Informal Resolution

Before initiating formal proceedings, please contact us at [email protected] to attempt to resolve the dispute informally. We commit to responding within 30 days.

16. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to:

• Acts of God, natural disasters, pandemics
• War, terrorism, civil unrest
• Government actions or regulations
• Internet or telecommunications failures
• Third-party service provider outages (AI providers, hosting, payment processors)
• Cyber attacks or security incidents affecting our infrastructure

17. Severability and Waiver

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Our failure to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision unless acknowledged in writing by us.

18. Changes to These Terms

We may update these Terms from time to time. When we make material changes:

• We will update the "Last updated" date at the top of this page
• We will notify you via email at least 30 days before the changes take effect
• We will display a prominent notice on the Website or in your dashboard

Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and may close your account.

19. Entire Agreement

These Terms, together with our Privacy Policy andCookie Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.
